Our Generic Summary of Cover for Liability

The following is a general description of the features and benefits typically available to policyholders. It is not intended to be a complete summary of the policy cover available as such cover will vary between Insurers.

With each quotation provided by Aldium a Key Facts Summary of Cover will be supplied for the particular Insurer recommended.

PUBLIC LIABILITY

The policyholder will be protected against all sums which the policyholder is liable at law to pay as damages plus claimants costs and expenses for accidental:

  1. injury to a person
  2. damage to property
  3. obstruction, trespass, nuisance or interference with a right of way, light, air or water.

The injury, damage etc must have occurred within certain territorial limits as defined in the policy.

The injury, damage etc must have occurred in some connected way to the business of the policyholder.

The injury, damage etc must have occurred during the period of insurance.

The Insurance Company’s cover under the Public Liability Section is limited to the amount which is stated in the actual policy schedule. This is usually £????????? and the limit applies to any one claim against the policyholder or any series of claims arising from a single occurrence.

What is not covered

  1. Injury to employees.
  2. Damage to the policyholders or an employees own property or property under the control of the policyholder or an employee (Personal Effects are often covered).
  3. A policy excess may apply to claims for loss of or damage to property.
  4. Liability which only arises because of an agreement which would not have arisen if that agreement had not existed.
  5. Liability for the cost of repairing or replacing defective goods which are sold or supplied.
  6. Liability for putting right defective workmanship.
  7. Liability for wrongful advice given or faulty design where the policyholder has been paid separately for such advice or design.
  8. Liability for the payment of fines, penalties, punitive, exemplary, aggravated, liquidated or multiple damages.
  9. Liability which arises from the use of watercraft, hovercraft or aircraft.
  10. Liability which arises from the use of any mechanically propelled vehicle which is required to be insured under road traffic legislation.
  11. Liability arising from hot work including the use of blow lamps, hot air guns, welding or flame cutting equipment.

The above is not a complete list of all policy exclusions and neither do all Insurers impose all of the above. It is intended to be representative of the most significant exclusions which usually appear.

Additional cover

  1. If the policy is issued in joint names, each will be treated as though a separate policy had been issued to each.
  2. Legal costs and expenses incurred in attending at a coroner’s inquest or defending an action in a court of summary jurisdiction.
  3. Liability arising by reason of Section 3 of the Defective premises Act 1972.
  4. Costs and expenses incurred in defending an action brought under Health & Safety or Consumer Protection legislation.
  5. Liability arising out of the use for the business of any motor vehicle not belonging to or provided by the policyholder.
  6. Liability for loss or damage to premises hired to or rented to the policyholder provided such liability has not been created solely by a tenancy or similar agreement.
  7. Liability arising out of ownership or use of mechanically propelled plant whilst such plant is being used as a tool of trade. (Exclusions 9 &10 above still apply)
  8. Liability arising out of the employment of temporary workers.
  9. Liability arising out of use by the policyholder of bona fide subcontractors to carry out work in connection with the business.

EMPLOYERS LIABILITY

The policyholder will be protected against all sums which the policyholder is liable at law to pay as damages plus claimants costs and expenses for:

The injury must have occurred during the period of insurance.

What is not covered

  1. Liability for bodily injury sustained when the employee is carried as a passenger or is getting onto or off the vehicle in circumstances where road traffic legislation requires compulsory insurance to be in place.
  2. Liability arising out of any work undertaken or a visit offshore.
  3. Liability arising out of any process involving asbestos or asbestos products.

Additional cover

  1. Costs and expenses incurred in defending an action brought under Health & Safety legislation.
  2. Payment of the amount of the compensatory damages and costs awarded to an employee against a person or body, which is not the policyholder, which has not been paid after 6 months
  3. Liability arising out of the employment of temporary workers.
  4. Compensation for court attendance costs.
